ARTICLE XXIII, Department of Residential Health Care Services

Section 23.01. Department of Residential
Health Care Services; Commissioner.
There shall be a Department of Residential Health Care Services headed by a
Commissioner who shall be appointed by the County Executive, subject to
confirmation by the County Legislature on the basis of his administrative
experience and his qualifications for the duties of the office. He shall serve
at the pleasure of the County Executive.
Section 23.02. Commissioner of Residential
Health Care Services; Powers and Duties.
Except as otherwise provided in this Charter and by law, the Commissioner of
Residential Health Care Services shall:
- manage and supervise the Residential Health Care institutions of
the County;
- have all powers and perform all the duties conferred on or required of
such a commissioner under the Public Health Law or other applicable law, rule
or regulation;
- shall perform such other and related duties required by the County
Executive.

Section 24.01. Department and
Environmental Facilities and Services; Commissioner; Appointment;
Qualifications; Term
There shall be a Department of Environmental Facilities and Services under the
direction of a Commissioner of Environmental Facilities and Services, who shall
be appointed by the County Executive, subject to the approval of the County
Legislature. He shall be directly responsible to, and serve at the pleasure of,
the County Executive.
All existing County, water, sewer, solid waste and other related bureaus and
agencies, the functions of which are subsumed in the functions of the Department
of Environmental - Facilities and Services, are hereby abolished as separate and
independent entities or as subdivisions of other County departments and
agencies, and are hereby incorporated in the Department Environmental Facilities
and Services, and responsibility for their functions, powers and duties is
hereby assigned to the Commissioner of Environmental Facilities and Services,
his deputies, directors, staff and agents. All of the books and records, and all
County equipment, property and material in the custody of others shall hereby
become the custodial property of the Department of Environmental Facilities and
Services, the transfer, allocation and management of same to be accomplished
under the direction of the County Executive.

Section 24.02. Commissioner of Environmental
Facilities and Services; Powers and Duties.
Except as otherwise provided in this Charter, the Commissioner of Environmental
Facilities and Services shall:
- have all the powers and duties of a county officer and/or
engineer and of a Chief County Environmental officer, pursuant to the
Environmental Conservation Law, the Public Health Law, County Law, Town Law or
other applicable law, rule or regulation;
- have charge and supervision of the design, construction, operation,
improvement, maintenance and repair of all water, potable and non- potable
water source, collection, transmission, distribution, treatment, storage and
disposal, sewer, sewage collection, treatment and disposal, solid waste
management, recycling, sludge, waste-to-energy, and other necessary and
related facilities, structures, land fills, transfer stations, buildings,
plants, tanks, transmission lines, real and physical property, and all other
property and facilities related to and required for the performance of his
duties, under the jurisdiction of the County;
- serve as the Chief County sewer, water, refuse disposal and recycling
agent, and as such shall have responsibility for any County functions related
to water supply and distribution, sanitation, water, solid waste disposal ,
and recycling and he shall supervise and be the Chief Administrative Officer
of all County sewer, water, and refuse disposal districts.
- Any existing County agencies, bureaus or departments, or parts of same
manifesting any jurisdiction or control over any of the foregoing, shall be
deemed to have been transferred, merged, or otherwise combined with the
Department of Environmental Facilities and Services, under the Commissioner
Environmental Facilities and Services, as the County Executive may direct, and
in compliance with applicable law, rule or regulation, as of the date this
Article takes effect, and all of their books and records and all County
property in their custody shall thereupon come under~ of the Department of
Environmental Facilities and Services;
- except as may otherwise be provided in this Charter or the Administrative
Code, the Commissioner shall have all the powers and perform all the duties
now or hereafter conferred or imposed upon him by law, together with such
other and related duties required by the County Executive.
- Subject to provisions of the Civil Service Law, be the appointing
authority for the naming of heads of divisions, or bureaus within the
department.

Section 24.03. Division of Environmental
Engineering; Director.
There shall be within the Department of Environmental Facilities and Services a
Division of Environmental Engineering under the supervision of a Director. In
Addition to the powers and duties of a County Engineer provided in this Chapter
and by applicable law, the Division shall furnish environmental engineering and
other services to the County Legislature, the County Department of Public Works,
the County Planning Department and such other County departments and agencies as
may be directed by the County Executive. The Director of Environmental
Engineering shall also perform such duties as may be assigned by the
Commissioner of Environmental Facilities and Services.

Section 24.05 Division of Sewerage;
Director.
There shall be a Division of Sewerage under the supervision of a
Director who shall be appointed on the basis of his experience and
qualifications for the office. He shall, under supervision of the Commissioner
of Environmental Facilities and Services, exercise the powers and duties
provided for such officer by this Charter, by the Administrative Code, or by
applicable law, rule or regulation.

Sec 24.06. Division of Solid Waste;
Director.
There shall be a Division of Solid Waste under the supervision
of a Director who shall be appointed on the basis of his experience and
qualifications for the office. He shall, under the supervision of the
Commissioner of Environmental Facilities and Services, exercise the powers and
duties provided for such officers by the Charter, the Administrative Code, or by
applicable law, rule or regulation.
